Introduction

What are the Terms of Service?

The Terms of Service is a contract between Schedule My Teachers (“we”, “us”, “the Company”) and its customers and subscribers (“you”) which explains the terms and conditions of using the Schedule My Teachers software and website, which we refer to collectively as the “Service.” The Terms include the provisions set forth in this document and in the Schedule My Teachers Privacy Policy and other terms or conditions that may be presented by us and accepted by you from time to time in connection with specific Service offerings (all of which we collectively refer to as the “Terms of Service” or “Terms”). If you agree to these Terms on behalf of a legal entity, you represent that you have the authority to bind that legal entity to these Terms. If you do not agree to these Terms, then you do not have the right to access or use our Service. If you do register for or use our Service, you shall be confirming your acceptance of the Terms and your agreement to be a party to this binding contract. If you use the Service, you acknowledge, accept, and agree to all provisions of the Privacy Policy as well.

Although significant changes are rare, these terms may be amended as new features, technology, or legal requirements arise, so please check back from time to time. We will notify you if we make a significant change and, where required, seek your consent. If we do update these Terms, you can decide whether you want to accept the updated terms or stop using our Service. Your continued use of the Service after the effectiveness of that update will be deemed to represent your agreement with, and consent to be bound by, the new Terms.

What is the Schedule My Teachers Service?

The Schedule My Teachers software, the Schedule My Teachers service, and other products, services, and websites hosted or made available by Schedule My Teachers are included in the Schedule My Teachers Service.

Who are the parties in this contract?

You, the user, customer and/or subscriber, are one party to this contract. We, Schedule My Teachers, are the other party to this contract.

Using the Service

What are my rights in the Schedule My Teachers service?

Once your subscription is paid and you accept these Terms, we grant you a limited license to use the Service subject to these Terms for as long as your subscription payment is up to date, for as long as you are not barred from receiving the Service under the laws applicable to you, or until we end your subscription pursuant to these Terms.

What am I not allowed to do?

By purchasing and retaining a subscription, you agree not to:

• modify, alter, or create derivative works of or from the Service without explicit permission by Schedule My Teachers to do so.
• reverse engineer or otherwise make an attempt to derive source code from the Service without explicit permission by Schedule My Teachers to do so.
• make schedules for other schools other than your own or give other people access to the Service so they can make a schedule for their school by themselves.

What are the rights of Schedule My Teachers relating to the Service?

Schedule My Teachers retains the right, in its sole discretion, to implement new elements as part of and/or ancillary to the Service, including changes that may affect the previous mode of operation of the Service. If any changes are made, they will be made with the intent of bettering the performance or usability of the Service in one way or another. However, you may disagree. In addition, Schedule My Teachers retains the right to limit the amount of data and/or memory made available to you. 

Schedule My Teachers also retains the right to allow particular affiliates or third parties to provide technical or other services relating to all or part of the Service. This right also extends to Schedule My Teachers use of computer software supplied by third parties which is utilized with their implicit or explicit permission. Schedule My Teachers expressly disclaims any warranty or other assurance to you regarding such third party software.

The Service and its original content, features, and functionality are owned by Schedule My Teachers and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

Do you offer any warranties?

The Service is provided to you “as is” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, we, on our own behalf and on the behalf of our affiliates and our and their respective licensors and service providers, expressly disclaim all warranties, whether express, implied, statutory, or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage, or trade practice. We make no promise, guarantee, or representation of any kind that the Service will meet your requirements, achieve any intended results, be compatible or work with any other software, apps, systems, or services, operate without interruption, meet any performance or reliability standards, or be error-free, or that any errors or defects can or will be corrected. Some jurisdictions do not allow the exclusion of or limitations on implied warranties or the limitations on the applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to you.

Are you at all liable of my use of the Service?

To the maximum extent permitted by applicable law, we nor our affiliates or our and their respective licensors or service providers, have any liability arising from or related to your use or lack of use of the Service for:

• personal injury, property damage, lost profits, cost of substitute goods or services, loss of data, loss of goodwill, business interruption, computer failure or malfunction, or any other consequential, incidental, indirect, exemplary, special, or punitive damages.
• direct damages in amounts that in the aggregate exceed the amount actually paid by you for the Service.

Can I share my subscription with someone else at my current school?

Subscriptions should only be shared with faculty and staff who work with you at your current school. In cases where multiple people at the same school are using the same Schedule My Teachers subscription, it is strongly recommended that no sensitive information (e.g. a private password used for important accounts purposes) is stored in the subscriber’s information.

At the same time, you are responsible for keeping your passwords secure. You are solely responsible for any activity that occurs under your subscription. If any unauthorized use of your subscription or any other security breach related to the Service occurs, you must notify us immediately. If a security breach occurs or is likely to occur, we may freeze your subscription and your use of the Service until your password is changed.

Can I share my subscription with another school?

Subscriptions cannot be shared with faculty and staff who work for a school which is different than your current school. If it is discovered that this prohibited sharing of the Service is committed by a subscriber, that subscriber’s subscription will be immediately revoked and no refund of any kind will be given.

Payment and Billing Terms

What payment methods are accepted?

Credit cards are the only acceptable methods of payment. Payment in checks, cash, or in any other form is not allowed.

Do I have to pay in full at the time of sale?

Due to the nature of the Service, subscriptions must be paid in full at the time of sale before use of the Service.

Subscription and Renewal Terms

How long is a subscription to the Service?

Subscriptions to the Service are one year in length.

What if I want to end my subscription early?

If subscribers want their subscription ended early and their accounts terminated beforehand, we will do so. However, due to the nature of the Service, a refund will not be given.

When does my subscription begin and end?

Your subscription begins as soon as your payment is processed and ends exactly one year later. For example, if a one-year subscription was purchased on April 29th, 2021, that subscription would expire on April 29th, 2022, which means the last day to use the Service would be April 28th, 2022.

Will my subscription be automatically renewed?

Yes, your subscription will automatically renew one year from your original purchase date. You will be notified via email two weeks before your subscription is automatically renewed.

Can I stop my subscription from automatically renewing?

Yes, you can stop your subscription from automatically renewing by emailing us at help@schedulemyteachers.com and telling us to stop your automatic renewal.
